Comprehensive legal advice on NJ civil unions/same-sex relationships agreements and registration, including estate planning & wills

New Jersey recognized legal civil unions/same-sex relationships beginning in 2004, giving same sex and opposite sex (62 and older) partners the same rights and responsibilities enjoyed by married couples, including property rights, child custody and retirement / healthcare benefits. In 2007, New Jersey also became the third state to offer civil unions/same-sex relationships, which gives gay couples the same rights as their heterosexual counterparts in marriage.  The consequences of this act are a boon to couples unable to marry legally. It is important to remember, however, that this act carries with it some of the responsibilities of a married couple, leading to unintended consequences for individuals unaware of the full extent of their support and property obligations.

As part of our extensive Family Law practice for our clients, the attorneys at Adinolfi & Spevak, P.A., can develop, prepare and implement comprehensive, legally sound civil unions/same-sex relationships agreements prior to official civil unions/same-sex relationships registration. Like a pre or postnuptial agreement for married couples, civil unions/same-sex relationships agreements could answer questions of child custody, financial obligations and tax issues in advance of registration, thus avoiding costly litigation upon the potential dissolution of the relationship.

Civil unions/same-sex relationships agreements and registration are not only for same-sex couples, however. Cohabitating partners over the age of 62 may also register in order to preserve healthcare and retirement benefits and to protect property and assets that might be loss upon remarriage. A lawyer from the Haddonfield offices of Adinolfi & Spevak, P.A., can provide preemptive counseling prior to registration and will advise you on you rights, your options and the possible consequences of your decisions. We believe that an informed client is best equipped to make choices that are in their own best interest, and we will provide personal service, clear communication and prompt, confidential handling of all inquiries.
